1) Eligibility (17+)
The Service is intended for users aged 17 or older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.
2) The Service
ZovraSync allows you to transform pet photos into creative images by capturing or importing photos, adding accessories (such as hats, glasses, hairstyles, and other elements), adjusting layouts, saving and organizing creations, and viewing historic edits.
We may update, change, suspend, or discontinue any part of the Service at any time.
3) Accounts
- Registration: you may be required to create an account and provide information such as name, username, and email address.
- Security: you are responsible for safeguarding your credentials and for activity under your account.
- Accuracy: you agree to provide accurate and up-to-date information.
4) User Content and Permissions
User Content includes photos/images, text, and other materials you upload, submit, generate, or store through the Service (including creations and edits).
License to operate the Service: You grant ZovraSync a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display your User Content solely to provide, maintain, and improve the Service and to fulfill your requests (for example, to generate an edited image you ask for).
If you choose to use features that upload photos/images or text to our servers for processing, you authorize that processing to produce the requested output, handled according to our Privacy Policy (including deletion after processing).
You are responsible for your User Content and represent that you have all rights necessary to upload and use it.
5) Prohibited Conduct
You agree not to:
- Use the Service for illegal activities or to violate applicable law.
- Infringe intellectual property or privacy rights of others.
- Upload malicious code, disrupt the Service, or bypass security.
- Reverse engineer, decompile, or attempt to extract source code except where allowed by law.
- Generate or distribute unlawful, harmful, abusive, or otherwise inappropriate content.
6) Intellectual Property
- Our materials: the Service and related IP are owned by ZovraSync or its licensors and protected by law.
- Your content: you retain rights in your User Content, subject to the limited license you grant under these Terms.
7) Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and disclose information.
8) Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind.
We do not guarantee uninterrupted or error-free operation.
9) Limitation of Liability
To the maximum extent permitted by law, ZovraSync will not be liable for indirect, incidental, special, consequential, or punitive damages.
To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the amount you paid to ZovraSync for the Service in the 12 months before the event giving rise to the claim (or USD $10 if you paid nothing).
10) Indemnification
You agree to indemnify and hold harmless ZovraSync and its team members from claims arising out of your User Content, your use of the Service, or your violation of these Terms.
11) Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if needed to protect the Service or other users.
12) Governing Law and Dispute Resolution (Binding Arbitration)
- Governing law: laws of the jurisdiction of our principal place of business, without regard to conflict of laws principles.
- Binding arbitration: disputes will be resolved by final and binding arbitration rather than in court, except small claims where eligible.
- Class action waiver: disputes will be brought only on an individual basis to the extent permitted by law.
13) Changes to These Terms
We may update these Terms from time to time. We will update the Effective Date above and, where required, provide additional notice. Continued use means you accept the updated Terms.
